- Interfering with the operation of the platform
8. Third-party services
Some functionality may rely on third-party technology providers, described in our Privacy Policy. Reference to a third-party provider does not imply that provider endorses Nia.
9. Intellectual property
Nia branding, website content, software, and related materials belong to Nia Payments or its licensors. You may not copy, modify, or distribute them without permission.
10. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information.
11. Account suspension and termination
We may suspend or terminate access to Nia if we reasonably believe these Terms have been violated, or if necessary to protect the security or integrity of the service. Where practical, we will provide notice.
12. Account deletion
You may request deletion of your account at any time. Instructions are available at niapayments.io/delete-account.
13. Service availability
Nia may occasionally be unavailable due to maintenance, technical issues, service-provider interruptions, security events, or updates. We do not guarantee uninterrupted availability.
14. Disclaimers
Nia is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties of any kind, express or implied, regarding the service, including its accuracy, reliability, or fitness for a particular purpose.
15. Limitation of liability
[Marked for legal review.] To the maximum extent permitted by law, Nia Payments’ aggregate liability arising from your use of Nia is limited to the amount, if any, you paid to Nia Payments in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential damages, or for losses arising from your own arrangements to send or deliver funds.
16. Indemnification
You agree to indemnify Nia Payments against claims arising from your misuse of Nia or your violation of these Terms, to the extent caused by your own actions.
17. Governing law
[Marked for owner and legal confirmation.] These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
18. Changes to the Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “Last updated” date.
